Visakhapatnam: In a first-of-its-kind judgment in Visakhapatnam jurisdiction in recent times, a court on Monday ordered the filing of a perjury complaint against a woman for concealing her educational qualification while lodging a 498-A case against her husband and father-in-law, who had in fact supported her education, according to advocate for the dowry accused, P. Vamsidhar.He said the Additional Chief Judicial Magistrate Court, Gajuwaka, presided over by Y. Srilakshmi, acquitted both the husband and father-in-law in the case, which was filed in 2020 under Section 498-A of the Indian Penal Code (IPC) and Sections 3 and 4 of the Dowry Prohibition Act, 1961, based on the wife’s complaint. During the trial, the dowry harassment allegations were found to be false. The woman also made a false sworn statement, claiming she lacked sufficient qualifications to earn a livelihood. However, this was disproved by the defence through documentary evidence. According to her academic records, she had completed a B.Tech. in Computer Science and Engineering from Jawaharlal Nehru Technological University (JNTU), Kakinada. Her husband, a bus conductor, submitted evidence showing that he and his father had supported her education. The court has directed that perjury proceedings be initiated under Section 340 of the Code of Criminal Procedure (CrPC), and instructed its Superintendent to file a complaint before the III Additional Chief Judicial Magistrate Court, Gajuwaka, for appropriate legal action against the woman, the advocate said.
